These Terms and Conditions apply to all transactions on this site.

Please read them carefully.

They do not affect your statutory rights.

We may change these terms and conditions at any time. Any changes will take effect on the date they are posted onto the site (see date above). You will be asked to read and accept the terms and conditions each time you place an order, to ensure that you are familiar with the most current ones. It is accepted that once an order is completed that you as the customer has read, understood and accepted our terms and conditions and all related policies.

Our Contract

All submitted orders are accepted as checked and correct by you.

All orders will only be processed once payment in full is received.
Please note even though our ordering process is automated, all actual transactions are done manually.  If your item is out of stock, we will endeavour to contact you for further instructions, failing so we will issue a refund.
 
Upon finalising your order and submitting, it is taken as an acceptance of your order and the creation of a legally binding contract between us (Battle Gear and yourself). Alternatively, we may decline all or part of your order for any reason, in which case an e-mail from us will inform you.

We reserve the right to refuse and decline any order for any reason. This helps to protect you and us against fraudulent transactions. We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method.

Prices and Payment

All prices and charges on this site are in UK pounds unless otherwise stated and exclude delivery charges .

IMPORTANT: We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we may cancel your order at any time up to the point we send the product(s) to you. We will contact you where we become aware of an error and ask you whether you wish to continue with your order at the correct price or cancel it. If we do cancel your order you will receive a full refund of any charges paid in advance.

We accept payment by Mastercard, Visa, Delta, Switch, Maestro and Electron via Paypal & Paypal Checkout. Payment is deducted when you complete your order. Unfortunately we do not accept American Express, Diners Club and Solo cards. Please ensure that you are the owner of the card you are using or have express permission to use it.

International Orders

We ship to pretty much anywhere in the world! For international orders it is recommended that you email us your order at
bttlgear(at)aol.com and we will quote you for the shipping which is additional, once accepted we will then send you an email for the total. For all international orders we only accept paypal payments & will send you a paypal invoice once we have totalled up your email order with international shipping charges and paypal fees.

Events beyond our control

We shall have no liability to you for any failure to deliver any goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstances beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire explosion or accident.

Return Policy

*Please note that all postage of any item for whatever reason sent back to us will NOT be refunded, however in the case of faulty products, damaged products or any situation that requires a replacement, postage back to you will be covered by us. This does not apply if you simply want to return a product to be exchanged for another. In this case postage must be paid by you both ways.

Due to the nature of most of our products, once an item is worn, used or washed we cannot accept any form of return.

You can return your purchase at any time either before or up to 7 working days following the day you receive the goods by:

For change of mind cancellations and returns, a re-stocking fee of 20% of the original product price may be charged. Postage will not be refunded. Postage back to us will not be covered.

Refunds will only be made after the purchase item/s are returned to us. All refunds will incur a £1 transaction charge. (change of mind cancellation only)

All return items must be in 100% brand new condition with all the relevant packaging intact. Your returned product must be complete and in 'as new' condition e.g. if you have opened the box to examine the product you must have done so without damaging or marking the product or packaging. It must not have been used in any way. It should be returned with the original box, packing and accessories you received with it. Any 'Free Gifts' received with the product must also be returned.

For all returns, a collection from you can be arranged at an extra charge.

We cannot cancel your purchase when:

--- if you have used, worn or washed the product in any way.

--- the goods were a special order to your specification or specially ordered for you.

Faulty Goods
The following are guidelines. Wherever possible we will respond to your individual circumstances.

In the unlikely event that there is a fault or defect with your product upon receiving it, we will normally offer a prompt exchange and offer a replacement. In all cases we reserve the right to inspect the product and verify the fault.

To qualify for a refund or exchange the product must be:

--- in otherwise 'as new' condition

--- complete with the original packaging, accessories and any free gifts offered with it.

For defects and faulty products, please contact us at
bttlgear(at)aol.com and title the email ' Faulty products'. Please include all contact and order details and a short description of the fault. A staff member will get back to you very shortly.

These terms does not cover faults caused by accident, neglect, misuse or normal wear and tear and consumable items.

Postage back to us will not be refunded however in the case of a replacement, repair or exchange postage back to you will be free.

We, our Group companies and our suppliers own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited.

General

These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.
We reserve the right to refuse access to this website, to remove or edit content, or to refuse or cancel orders at our discretion. If we cancel an order, it will be without charge to you, and we will reimburse any payment made by you. Additional terms and conditions may apply for prize competitions, pre-release orders and specified offers. If so, you will be alerted to them at the relevant juncture.

Product Warranty

All damaged deliveries or shortages must be reported within 24 hours of receipt.

Due to the nature of our wearable products, all Kimonos, tshirts, shorts, rashguards and other similar wearable products do not come with a warranty. All other products come with a 30 day manufacturing warranty.

Battle Gear is committed to protecting your privacy. We have taken all the essential measures to make sure that any information you give us, including credit card details, remains private and secure and that your payment and registration information is processed with total confidentiality.

Furthermore, as required by the UK Data Protection Act 1998, we follow strict security procedures in the storage and disclosure of information, which you have given us, to prevent unauthorised access.

What information do we gather and what do we do with it?

When you order products, we will collect your name, contact and billing information, transaction and payment information. We use this information so that we can contact customers if there is a query with their order, for internal record keeping and for internal marketing purposes.
